Halcyon MD SRL ("Halcyon") provides MyPersonalGame.com as a free-to-use service, where users can create and download customized games. By using this service the user agrees to comply with the terms and conditions described in this document. This service includes the MyPersonalGame.com webpage and the generated games (Java midlets).

SUBMISSIONS

Halcyon cannot be held responsible for any copyright infringement for images uploaded to www.mypersonalgame.com (the "Website"), that do not belong to the user or are not considered public domain. It is the user's sole responsibility to make sure that they have consent to use any image they upload, including photographs of someone else. Furthermore, it is the user's sole responsibility to make sure that the images uploaded are not obscene or defamatory.

You acknowledge that you are responsible for whatever material you submit, and you, not Halcyon, have full responsibility for the message, including its legality, reliability, appropriateness, originality, and copyright.

By accepting these terms and conditions, the user warrants that they are aware that many images on the internet may be protected by copyright laws. By uploading content, the user warrants that they own all proprietary rights, including copyright, in and to the content. In addition, to the extent that the content contains images of people or persons, they represent and warrant that you have obtained permission from all required parties.We reserve the right to modify or terminate the www.MyPersonalGame.com service for any reason, without notice at any time. We reserve the right to alter these Terms of Service at any time. We reserve the right to refuse service to anyone for any reason at any time. All the services marked "free" can, and will be used without any charge on the behalf of Halcyon. However, charges may be applied to the user, by using third-party services (ex. using internet access on their mobile devices, etc.), charges applied by other service providers, not by Halcyon (ex. Internet Service Providers, operators, etc.).

If any part of this agreement is found to be invalid or unenforceable, the remaining terms will stay in effect. This agreement does not prejudice the statutory rights of any party dealing as a consumer.

DISCLAIMER OF WARRANTY

The Service (website and game) is provided on an AS IS basis, without warranty of any kind, including without limitation the warranties of merchantability, fitness for a particular purpose and non-infringement. The entire risk as to the quality and performance of the Service is borne by you. Should the Service prove defective, you and not Halcyon assume the entire cost of any service and repair.

The user agrees that neither Halcyon nor any of its directors, officers, employees, partners, affiliates or agents shall be liable for any damages, whether direct, indirect, consequential or incidental, arising out of the use of, or the inability to use any content. The downloaded game is protected by international copyright laws, and we retain all intellectual property rights in the game. You may not separately publish, sell, market, distribute, lend, lease, rent, or sublicense the game or use it for any commercial purposes. However, this license is not to be construed as prohibiting or limiting any fair use sanctioned by copyright law, such as permitted library and classroom usage or reverse engineering.
